    Haven't you read on the Prospectus that Charles Green stated there are players going to sue Rangers, read paragraph 105.

    Certain players of RFC 2012 plc (Alan McGregor, Kyle Lafferty, Rhys McCabe, Sone Aluko, Steven Davis, John Fleck, Steven Naismith, Steven Whittaker and Jamie Ness) purported to object to the transfer of their contracts of employment to RFCL pursuant to TUPE. RFCL maintains that these purported objections were incompetent and that the players instead unilaterally terminated their contracts of employment in an unlawful manner. Arbitration proceedings under Article 99 of the Articles of Association of the SFA were commenced on 5 July 2012 in the name of RFC 2012 plc. Any damages due would be payable to RFCL. RFCL was not a member of the SFA at that time and therefore the reference had to be made by RFC 2012 plc. RFC 2012 plc accepts that it has no financial interest in the outcome. Discussions took place with representatives of some of the players and agreements have now been reached with Steven Davis, John Fleck and Rhys McCabe. Representatives acting on behalf of the remaining players have challenged RFCL's rights to participate in the process in any capacity given that it was not a member of the SFA at the time of the alleged breaches of contract and the date of the reference to the SFA under Article 99. A preliminary hearing has been fixed for 7 January 2013 at which these jurisdictional challenges will be determined. If RFCL is successful at this hearing, then the claims against the remaining players will proceed to a full hearing. At this point it is anticipate that such a full hearing will take place in March or April of 2013. Preliminary advice from senior counsel is that RFCL's prospects of winning these preliminary arguments are good. However, it is not currently possible to quantify these claims in full.

    CHARLES Green's threat to sue the Rangers players who refused to join his newco amounted to him seeking "modern slavery", according to Wil van Megen, the head of FifPro's legal department.

    Green yesterday repeated his intention to take legal action against the players who walked out on the club this week – Steven Davis, Allan McGregor, Steven Naismith, Kyle Lafferty, Steven Whittaker, Sone Aluko, Jamie Ness, John Fleck and Rhys McCabe – and he said he would also pursue transfer fees from whichever club they join.

    The chief executive described their actions as opportunistic while ex-player Sandy Jardine said they had shown "greed" in leaving the club as free agents instead of even staying for a short while and leaving for transfer fees.

    Most of the players who have decided to stay will report for fitness tests at Murray Park as Rangers' pre-season training programme begins under coach Kenny McDowall this morning.

    Carlos Bocanegra, Maurice Edu, Alejandro Bedoya and Dorin Goian will not turn up, having been given dispensation to arrive next week because of earlier international commitments, although it is believed all four will stay at the club. Neil Alexander, Kirk Broadfoot and Kyle Hutton will also stay. Fleck became the ninth player to confirm his departure yesterday. Juanma Ortiz was in talks with the club to secure a free transfer last night rather than necessarily objecting to his contract being transferred to the newco.

    Despite Green's threat of court action, the players who have decided to leave have been advised that their departures are legally sound. Dutchman van Megen from FIFpro – the federation of international footballers' unions – said Green would inevitably lose any court cases against the departing players.

    Van Megen worked with FIFPro and PFA Scotland on the Andy Webster freedom-of-contract case six years ago and said that because of TUPE (Transfer of Undertakings, Protection of Employment) legislation, the Rangers players could be entirely confident of winning in any legal challenge from Green.

    "He has no grounds to do that," said van Megen. "Under the European Council [EU] directive, it's quite clear that it [TUPE] has to be implemented in all countries. The Council directive is in Scottish law. The Council directive itself has a specific clause that if you refuse to go to another entity then you are free to do so, because you are not obliged to stay against freedom of labour legislation. That has to be respected. Otherwise it would be modern slavery if you were obliged to move from one entity to another.

    "There is no prospect of the players being frozen out of football [pending any court cases]. They are professional footballers and the labour agreement takes precedence at stages over football regulations.

    "I won't be surprised if Rangers criticized do challenge the lawyers, because sometimes the issue pops up and clubs do challenge it. But I don't think it would be a wise decision. The players can be quite confident that they can't be forced to join the new entity."

    Those who have walked out on the club were by Green. "I'm very, very disappointed of course, particularly so late in the proceedings," he said. "It is clear in the regulations: if someone has an objection they have to notify within 24 hours, this is nearly two weeks [since the transfer of contracts to his newco]. I think this is just opportunism. We will definitely challenge it, yes."

    And now 67 players are going to sue Rangers. Sorry Charlie you are on a losing battle here. :lol:

    Well this myth that Rangers Football club is still going is a lie, these players have stated that they are angry and disappointed that Rangers Football Club no longer exists in it's current form.

    He's really not an opportunist, he's just a smooth talker deflecting proper answers of the club on that interview on talksport so he's the same shyster as Craig Whyte, but hey enjoy the floatation you deserved it for the club i mean Charles Green pockets. ;)

    Charles Green has reiterated his stance that Rangers will not play in the Scottish Premier League as long as he is at the club.

    The Ibrox chief executive, who bought the club for £5.5m in June, is adamant the third division outfit will 'not play where they are not wanted'.

    Green is sticking by the promise he made during the summer when Rangers were voted out of the top flight due to unpaid taxes and National Insurance payments. So no more Champions League hmm..

    Charles Green, who is leading a consortium to acquire Rangers Football Club, issued the following statement today.

    Mr Green said: "I am hugely disappointed by the decision of HMRC not to support the CVA proposal and that disappointment will be felt acutely by Rangers fans across the world.

    "Frankly, I do not see what benefit will be achieved by this decision. My consortium's offer for a CVA amounted to a total of £8.5 million.

    "Now that we will have to complete the purchase via the formation of a NewCo (new club, the purchase price and therefore the amount available to creditors will be £5.5 million.

    "I can understand HMRC deciding that football clubs which do not pay their taxes need to be punished, but by effectively banning Rangers from Europe for three years all that will happen is that there will be less revenue generated by the Club and consequently less money paid over to the taxman.

    Poor Ragers fans they think that a company is separated from the club which is bullshit. Rangers International Football Club PLC is the holding company that owns Rangers Football Club Limited.

    And that share money will go through the holding company so the club gets feck all a complete scam success by master chuckles.

  8. A club the size of Rangers needs a company to operate it

    The transfer relates to the membership being transferred from one company to another, not club to club

    New clubs are GRANTED memberships, this was not the case with Rangers, the club still existed

    You are also now ignoring that the same situation has happened with another 3 clubs and continuation is universally accepted with those clubs, check the UEFA page on Fiorintina

    It may be simpler for you to simply say "I accept it happened for those 3 clubs" I cannot accept it for Rangers, this would make your stance quite clear but not your reasons and to be honest this does not bother me at all

    Tedi Company and Club cannot be separated they are both a one entity so old Rangers (theclub) died along with the old company. I repeat A company cannot be separated from the club.
