I may be jumping the gun, as it's unclear if they need to be a director in both - however if Murray is involved again in any capacity it seems pretty shady

I agree on the Murray thing it is shady and if I was a cynical soul I would maybe be of the way of thinking that Green and Whyte might well be on the payroll of MIH.

However the quote you posted is quite clear, all three criteria should be met.

one or more directors (including shadow directors) who are common to both the liquidated company and the successor company, and

there was Revenue debt of £10,000 or more (actual or estimated) in respect of the liquidated company, and

the same trade or business is carried on by the successor company.

When the news of the World first ran the EBT story a number of Rangers fans on here put forward the notion that MIH would be paying the bill. The FTT results are due out shortly, Murray may just have been asking Green how much do I owe the Tax man on Rangers behalf.

Or they could be getting their story straight so they are both singing from the same hymn sheet when Hector finds them guilty next month.smile.gif

Okay, everyone here knows my views on the whole Rangers/Sevco thing but I think you are barking up the wrong tree here. Is there a director or indeed shadow director who is common to both companies?

I believe we went over this topic of directors and shadows during the appeal/tribunal where they whined about the transfer embargo. Did one of the bigwigs adjudicating not say that a "shadow director" was a person who, while not a director, nevertheless had an executive role in running the company. He used an example of a football club where the manager selected the players to buy or sell, players to pick, and so on, as performance on the pitch is linked to performance in the till.

Step forward, Alistair McCoist, methinks - before we even have to unravel who is, or isn't, pulling his strings.

I'd like to see a link to that if possible because if so they're screwed.

I'll pick the bones out of this later but I'd say that in McCoist's role of manager he would direct the board as to acquisition of players etc.

Risky actions

Some examples of actions that could risk imposing shadow directorship include:

Imposing financial reporting requirements on the company, or taking control of the financial affairs of the company.

Making, or substantially influencing, major strategic decisions of the company, or exercising any power of veto over the company’s decisions. Choosing players to bid on?

Negotiating with third parties on behalf of the rest of the board. Negotiating transfer fees? Player contracts?

Controlling the appointment of senior management of the company. Appointing assistant manager and coaches?

Ultimately, whether such actions can make a person liable as a shadow director will depend on the facts of each case.

There's some hidden agenda "Baldrick style" cunning plan going on, with the tax man hovering and dual contracts, possible criminal proceedings all hiding in the wings in the newco's infancy up pops Chicos new mate and previous slayer of rangers Mr Minty moonbeams looking to reinvest and give Hector the bullet for the gun to finally exterminate the club, not to mention the possible back lash from the fans who see him as the cause of the collapse. I'm just waiting on the press conference where Green & Murray announce Craig Whyte as new Cheif financial officer and Paul Le Guen back in charge of the 1st team with 1st signing being an ageing Tore Andre Flo to keep the fans happy as they launch a share scheme

Serious bizarre goings on, or is the grand plan extinction and asset stripping now the hate fury and media attention has dropped slightly being in the 3rd division

And how about John Terry to shore up the defence. I see that arrogant bigot believes he is the victim ?? of a witch hunt. He continually delayed his hearing by questioning the make up of the panel and has managed to convince thousands of halfwits that he is innocent. He would fit in perfectly.

What does securitise mean?

Resi? What's that?

Securitise could mean use future sales as security for a loan from a company like Ticketus?
