The appeal

The club captain calling Shay a liar prior to that appeal

The club manager calling Shay a liar prior to that appeal

Lord Bonomy ( former Senator of the College of Justice, a judge of the Supreme Courts of Scotland, sitting in the High Court of Justiciary and the Inner House of the Court of Session and former Judge of the International Criminal Tribunal for the former Yugoslavia) and therefore, on the balance of probabilities, quite good at detecting folk who are or are not telling the truth, vindicated St Shay the Honest and trustworthy and not: "RA ESS EFF AYYYY on the balance of probability Logan was more convincing." 

 

And we're not "at each others throats" as far as I can tell it's just one arse cheek completely losing their shit because someone had the affront to criticise them and their club. While the other disgusting arse cheek taunts the aforementioned from atop their own stinking pile of prejudice. 

AFC and its fans don't seen to have a dog in this fight at all, since we know Shay is beyond reproach as a character, as established by the noble Lord Bonomy above.

May be wrong, but wasn't it decided on the balance of probability? Ie, The panel found that racial abuse probably took place, not that it definitely did?

That's just a description of the burden of proof required, as opposed to beyond reasonable doubt.

Lord Bonomy believed Shay and did not believe Tonev.  That's it.

Yeah, I get that, but it is still a distinction which has to be made.

I think a lot of what has happened since is largely pantomime, but with a lot of hypocrisy from huge parts of the Celtic support who indulge in it.

Not really. Celtic seem to want a a 9 month OJ Simpson esque show trial because it was wan o'theirs.

It's was sporting infringement, in a sporting association rule book.

And Tonev was proven to be exactly as guilty as he required to be in order to be found in breach of those rules.

Everything else said about " balance of probabilities" is just bollocks.

If it's based on the balance of probabilities then he has not been "proven" to be anything. Continuing to confuse the terms like that just makes it easier for people to argue against it.

Tonev is probably a racist and was banned for what he probably done. That should have been the end of the matter(Aside from an apology from Tonev and Celtic taking their own action on the matter).  Sadly, some couldn't accept that, and something that should be long forgotten by now(As much as an incident of that nature should be forgotten...) has dragged on and turned into even more of a shitshow, with victim blaming all over the shop form Celtic fans, Aberdeen fans sticking up for their player, and rival fans who don't really care about the incident itself  just happy to twist the knife and keep it running, for shits and giggles.

I have no idea if he wore gloves, nor do I care if they fitted.

Sorry he was proven to have met the burden of proof required to be found in breach. That's just how it is. That is what those words mean.

Press conference prior to the appeal and a Aberdeen v Celtic game at Pittodrie. You can find it yourself.

 

Historians will take care to note  the previous week the club, or someone associated with it claimed it was "too windy" to hear anyone being racist.  But not "too windy" to definitely know he didn't.
