I'm taking a Calmac ferry around the Small Isles tomorrow and if they're not twice as good as they were a couple of days ago I'll be dobbing in Nicola to Brussels.

This is not a political decision. EU procurement laws required the Scottish Government to put the contract out to competitive tender. If Serco had submitted the best bid, it would have been awarded the contract under those laws.

The Teckal exemption could have been applied and no tendering process would have been required. The cost of the tendering could have seen Calmac provide new tonnage to their fleet.

This tendering process was a waste of time and money and that lays firmly at the door of the SNP.

Calmac do not have a fleet, the Ferrys are leased from CMAL.

 

I am also not sure that the Teckal principle could be applied to this situation.  The only opinion I have seen on this was from Gordon Nardell and much press off the back of it and this was delivered well into the tendering process.  If the RMT were so against the tendering process, they should have sought the opinion before parties were invited to tender.  Probably after the Ferries Plan was published in 2012 would have been a good point to pressurise the government since this was the basis for the contract that Calmac just won.

You are aware of who introduced the tendering process in this instance, aren't you?

All owned by the Scottish Government. The millions wasted by Scottish Government owned bodies to tender to the Scottish Government for contracts could have been used by the Scottish Government for new tonnage.

In 2006 the then Scottish Executive, decided that under EU rules ferry services were required to be put out to tender, but this presented an issue as the vessels required to operate the services, and many of the ports to which services ran, were owned by Caledonian MacBrayne Ltd, giving it an unfair advantage over potential competitors.

The solution was to rename Caledonian MacBrayne Ltd as Caledonian Maritime Assets Ltd (CMAL) in order to retain the vessels and ports in state ownership, and a separate ferry operations company, CalMac Ferries Ltd, was created. It is a wholly-owned subsidiary of David MacBrayne Ltd, which is wholly owned by Scottish Ministers. (CMAL also retained ownership of the Caledonian MacBrayne brand, which CalMac uses as a trading name under licence from CMAL. The lion rampant device is also used by CFL with the permission of CMAL.)

CMAL is also wholly owned by Scottish Ministers and is based in Port Glasgow, Inverclyde. CFL and CMAL are two entirely separate entities. CFL provides certain services to CMAL under contractual arrangements.

Yes, I am aware of the ownership of both.  However, it doesn't take away from the fact that they are both individual entities.  If fact CMAL, cannot even operate the ports and ferrys at breakeven, so they also have that in common.

Forced Calmac to up their service so win win imo.

Calmac is owned by the Scottish Government. How have they forced Calmac to do anything? All they did was force them to spend money on tendering.

The RMT have forced the Scottish Government to look at their ineptitude.

No they haven't, they have jointly sought clarification of the EU tendering process.

 

They could of course just given you a call since you were adament that the Teckal principle could have been applied and negated the need to discuss it with the EU.
