johnnydun Posted March 30, 2022 Posted March 30, 2022 I have a question about Scottish courts... The neighbour (Beast) has had several court appearances, and his one recently was down on the court roll as 'Miscellaneous/Incidental Application'. To a simpleton like myself can someone explain what this means? I thought it might be an idea to start a law thread too. 0 Quote

Could be that someone has lodged a motion that requires a hearing, fiscal applying for an interim sexual offences prevention order, defence lodging a special motion. 1 Quote

Inanimate Carbon Rod has made a good suggestion although an interim SOPO is more likely to be heard in a civil court on application by the Polis than a criminal court. Miscellaneous or Incidental application could be anything e.g. motion to put off the trial because some berk of a clerk put it down for a public holiday and has just realised or for special measures for vulnerable witnesses - a remote video link to court etc. 2 Quote

It's true, he is up for multiple rapes. @Inanimate Carbon Rod, it is at the High Court, it has been delayed by 2 1/2 years because of Covid. So it could have been for an intervention from either party, about, well anything? 0 Quote

Ive been in a few ‘trial within a trial’ type things which have been marked up similarly, as have bail reviews etc. 1 Quote
