Nobody's taking a lower percentage from 3rd-42nd. 3rd-42nd would want a bump if 2 clubs are feeling so generous. Given that the SPFL agreed to this I’m not sure any legal challenge would be successful, although it probably wouldn’t stop a team trying. Kelty Hearts were put forward as champions in 2021/21 despite only 13 games of the season having being played. They didn't win the league either, just had favourable fixtures and a good start. Before it got that far I think it was the SFA and SPFL that got the rules looked over to see that they stood up legally. The 13 games / 3 games for Brora has since been amended. Any team participating in the SHFL and/or in the SLFL, which is a ‘Guest’, ‘colt’, ‘B’ ‘second’, ‘reserve’ or like or equivalent team of a Club participating in the SPFL shall not, under any circumstances, be eligible to receive the title of SHFL Champion and/or SLFL Champion or any other title related to its position in either of said Leagues or qualify for or be eligible for participation in the Pyramid Play-Off Competition at the end of any such Season. In such circumstances, the next best placed club (which is not a ‘Guest’, ‘colt’, ‘B’ ‘second’, ‘reserve’ or like or equivalent team of an SPFL Club) shall be eligible to participate in the Play-Off Tie, subject to Rules III(f), (g) and (k). Not quite: the SFA appoint an arbitrator, and the two parties can (if they want!) each appoint one. The latter are not there to 'put their case', but to form a tribunal and reach a decision jointly. And they needn't be QCs, or indeed KCs. Just on the SFA approved list: solicitors, advocates or judges.
