HMRC pursued a case they could never win other than in principal and at what expense to the Tax Payers? The defendants in this case don't exist HMRC saw them liquidated by turning down the CVA That decision resulted in many people losing any chance of some return on the money they were due and in the process HMRC have spent thousands if not million in legal fees to pursue justification over any hope of recovery. HMRC stood back for a number of years and happily allowed Rangers and other clubs to use EBTs - these were all shown in club accounts which HMRC had access to. So if anything this judgement only show how incompetent HMRC really are. I find the Diddy interpretation simpler. rangers cheated, then died.
