League Reconstruction 20/21 season

Recommended Posts

They really are grasping at straws to claim the order for discovery of documents as a victory.

The arbitration panel have the power to order disclosure, so they could have had that without the six-figure legal bill they're now facing ...

That's exactly how you're supposed to use square brackets within quotes - they're there to show that this is not a direct quote but is instead added to provide context.

Just re-read the quote, Clark was essentially saying that Hearts/Partick were correct in allowing the reconstruction process to come to its conclusion before petitioning the CoS. I had misread the quote, thinking it meant Clark had stated that reconstruction was still an option & that Hearts were trying to play silly buggers in their statement.

For the petition put before the Court of Session, Hearts and Thistle didn't ask for a revote - they asked for the relegation to be overturned or, alternatively, ten bajillion dollars.

I don't know whether they will, or have to, put the same thing before the arbitrators, but I don't expect they'll be asking for a revote there, either.

Aye, but you can't surely go to an arbiter with your own wishlist - there must be some basis to it - ie in this case the SPFL vote.

Would an arbitration panel sit for instance, if Dundee decided they should be awarded £20m and the league title?

Well I guess there's only one way to find out...

Hearts are like a boxer who wins the first two rounds of a fight, gets KTFO'd in the third and claims he won.

They didn’t even win the first 2 rounds, just they were able to stay on their feet despite everyone else seeing they had little chance and questioning if it was healthy for them to carry on.

Loving the idea that it is some sort of success to spend a fortune on your own (and the SPFL's) legal fees only to end up with an outcome that you could have had straight away.

And the nominated panel would no doubt have ordered recovery of documents anyway.

They're the football club version of Charlie Zelenoff. If they land 1 punch they claim a victory, whilst ignoring the tons of batterings they've received.

What documents are actually relevant?

They claiming that for some reason finishing bottom of the league should not mean they get relegated. Unless there is a document saying that ending the league early would not lead to religation then nothing else really matters regardless of how cocked up the SPFL managed the vote.

To begin with, someone could look at the petition of Dundee and see whether or not it even makes sense as a point of law; part of that was what went on today. Dundee United alleged that the judge could bin the petition because it failed purely as a legal document, even if all the facts of the case were lined up in Hearts/Thistle's favour. Turns out that wasn't the case, as per the ruling. There are legal methods of just dumping really bad lawsuits in the bin fairly quickly (by legal standards; it may take a while as the lawyers do need some billable hours to invoice folks for).

If you don't get the 3 referees to agree then it gets thrown out by compliance officer, two match ban and not allowed to play until October.
