Got a hire car arranged through my insurance company from Enterprise.

Had it 3 weeks and the clutch failed.

Long story short it was towed away to garage, all blame pinned on me.

My insurers told me not to worry and they'd deal with it.

This week Enterprise helped themselves to over 3 grand from my account.

Not sure whether I have any chance of ever seeing that again, but I'll be fighting for it back.

I've asked bank to get the money back and written formal complaints to LV and Enterprise.

Sounds like your insurers did indeed deal with it. 

What did you allegedly do to your clutch?

Burnt it out and/or melted it.

Allegedly due to my erratic driving.

I did 1000 miles in the car, it had 12,500 on the clock when I got it.

Hope you win this, it's outrageous, how are you supposed to check if the clutch is about to fail before driving off? Google tells me that Hertz calls clutch failure gross negligence on the part of the driver, seems arbitrary and grossly unfair to blame the driver who happens to be in the car when it finally fails, and there is no way they check the state of the clutch between hires. Only thing else you might do is get an independent mechanic to look at the clutch, maybe the insurance company could help with that?

I burnt out the clutch in a van once. Living in Wales, my house was on a very steep hill. I was moving house and filled the van and it just would not move uphill. And, Wales being full of utter scum, some guy parked his car right behind the van so couldn't reverse downhill. So I went for power and burnt it out.

You should message Joe Lycett. That’s just the sort of case he likes to pick up and batter in to the big company.
