The guts of our constitution is transparent and has been since 1689 when it was declared that parliament is sovereign and everything else is habit.

I am astonished that you even try to quibble this.

So the extent of Royal Prerogative?  It should be clear and coherent to you and I am amazed that you cannot provide the answer. :whistle

1688 was pre-Act of Union.  Scotland joined in 1707 as an equal partner.

Indeed and embraced the very notion that we are ruled by democracy not by fiat.

Sad that it's left to we Bears to uphold the right of parliament, yet again.  Hey we should have a tuneful and colourful celebration of it.  Maybe annually in July?

Democracy - ' a system of government by the whole population '.

Fiat - ' a formal authorization or proposition; a decree '.

I'd argue that Scotland's 'sovereignty of the people' is a little more democratic than Westminster's fiats.

The UK Constitution isn't always clear and coherent. Luckily in this instance the courts have clarified it for us.

And this suit the Government of the day. If the law goes against the Government, simply change the law. Brilliant!

That's just such a ridiculous headline, do the Daily Mail want judges to ignore the law when they're making decisions.

Yes,

Its not even just law, the principle that the executive cannot make law without the approval of parliament is really huge. You dont get some PM declaring that they are making a law on an opinion poll or even their interpretation of a referendum, parliament has to act as (at a minimum) a rubber stamp on the way that referendum is interpreted.

Its really poor rabble rousing. It runs against the deep grain of the English\Scottish\British political theory going back to the likes of John Locke and the post 1689 settlement. Checks and balances. The writers at the Mail know this. They are playing fast and lose not just with the UK constitution, but with the whole concept of our governance.

But does lizzy not by law have the final say. Ie if an appeal went from supreme.
I know she won't get involved in all that but does she have that power?

Following the Supreme Court ruling, there is a chance the Government could lodge an appeal to the European Court of Justice in Luxembourg, the EU’s highest court.
