They can make a shit decision knowing full well the VAR will get the blame if a terrible decision isn't overturned. Pretty much exactly the same as saying if one midfielder bursts past another and their shoulders or arms brush against eachother, its a foul and a free kick. Which is 100% isn't..... It is never a penalty.
