Did they not originally decide not to prosecute on the grounds of insufficient evidence before the fact that he'd lied on his medical records came to light? Surely they should be backing the private prosecution now that that information is public knowledge.

There could be something in the suggestion of funny handshakes and rolled up trouser legs.

Or there is just no reasonable chance of a prosecution. Done to death I know, but to be criminally liable, he would have to have known he was going to take an attach that day.

He could be prosecuted for lying to the DVLA, but frankly a £50 fine or whatever isn't going to make anyone happy.

I've also heard from a serving police officer that even if the private prosecution went ahead it would be fairly easy for Clarke's legal team to argue that he was not receiving a fair trial based on the amount of evidence that has been publicised during and since the FAI

Manitowoc county will hold a fair trial for him.

Unfuckingbelievable!!!

That not one of these pathetic c***s, who within hours of this tragedy unfolding, stated that Harry Clarke would not be prosecuted, can hold their hands up and admit they got it completely wrong.

Scottish Law - Once the envy of the civilised world.

This thread is beginning to read like one of those Facebook 'hang the b*****d' like and share posts.

Having said that, he really is a slippery c**t.

You make that sound like a bad thing.

What exactly do you want him prosecuted for?

What a seething mess.

There was no evidence at the time and there is still no evidence to prosecute him, therefore he cannot be prosecuted. If the Crown don't have evidence to prosecute, there's no chance that a family will have sufficient evidence to privately prosecute, so that has been correctly denied by the Lord Advocate. The Court will also deny the PP too.

At no point was Clark told by any medical professional that there was a realistic chance that he could have another blackout and that is the crucial point.
