Confirmation that the EBTs were undeclared secondary contracts?

David Murray funding Rangers virtually entirely via Bank Of Scotland loans, who once taken over by Lloyds TSB when the banks began to collapse and quite rightly wanted to see the colour of Murray's own money as security - and hence time for a sharp exit?

the first thing wasn't proven in the program.

the second was well known.

i'm talking here about the evidence presented in the program.

the first quote is half a sentence.

the second quote refers to something specified earlier in the document.

the third one is confirmation of the use of EBTs.

Did you have the program on mute or something? It's confirmation of the use of EBTs for non-discretionary payments - which would make them liable for income tax, and this income tax wasn't paid. Everyone's known for ages that EBTs have been used - that's never been in dispute. What has been in dispute is that they were used in lieu of a full salary - a "top-up". If you do that, you need to pay income tax on them. The side letter quote in Papac's case indicates that's what's going on.

now is it more likely that daly left out pertinent info or that he has took quotes deliberately out of context?

Given that the documents are in possession of a court, even if we took the least charitable view possible of Daly I don't think it's very likely that he'd lie by omission.

* has anyone asked what the sfa believed was happening with the millions pouring out rangers into EBTs every year that they had documentary evidence of?

Do the SFA actually look at club accounts?

When Duff and Phelps get horsed out of the picture, and Hector the inspector gets his man in , what will be the end game for Mordor .

Casino , Hotel , Theme park , Mosque , Tesco , Asda or an industrial retail park. Or will Hector hang on to Mordor for a few years and sell it to pay off the creditors, after the dark side are long consigned to life in the 3rd division

In civil law cases like the Big Tax Case, all HMRC would have to prove is that on the balance of probabilities, Rangers probably defrauded the taxpayer.

That's a big flaming jobby parcel on the SFA's doorstep too, given how they reacted to Whyte spending the PAYE money. Can't see UEFA being that understanding either.

Within the next day or so, we can anticipate the D&P exit strategy, accompanied with a statement to the effect that the are:

"....withdrawing on the basis that the unsubstantiated allegations made against us in a BBC documentary have undermined our ability to continue to effectively discharge the duties associated with the role of adminstrator. The allegations are an unwarranted distraction, and we must prioritise the interest of the creditors, and, as such, the future sustainability of Rangers Football Club. It is with considerable regret, therefore, that we have opted to withdraw our services at this time. Notwithstanding this, we can confirm that we will be seeking legal redress in the most strenuous manner....." *slither, slither....*

Ah, you might have a point there. Same guy is also saying Alaistair Johnston is the man to save the club by presenting the new administrators with the millions that fans will provide. Damn P&Bers :angry:

Anyone who is underwhelmed obviously doesn't understand the significance of some of the "revelations". Not every detail/consequence was spelled out. It appears the BBC has enough evidence to make a series on Rangers misdemeanours. That alone is hugely significant.

Murray should go to jail.

Thing is - such is the society we live in - has he done anything that's illegal? He ran-up huge debts with a bank, then wasn't able to pay them back properly - then sold one of his assets to someone for £1. Even if the EBT thing ever reached the point of criminal prosecution, he's probably far enough insulated from it's implementation - or could plead he thought he was behaving legally.

For those disappointed (or even pleased) that the programme was a little tame, or light on explicit detail, don't forget that the BBC lawyers are notoriously cautious. Nothing that could possibly prejudice any ongoing legal investigation would have been permitted on air. Nothing that could see the BBC paying $ in a libel case would have been broadcast. Usually in complex investigations such as the whole sordid RFC episode, journalists are drip-fed information from knowledgeable sources, stuff that ethics permit only to be used when there's 100% proof and no risk of legal shenanigans. Aficionados of 'All The Presidents Men' will see parallels here. Does the fourth estate have juicier stuff yet to officially see the light of day? I'd put my house on it.

Also, don't forget that this was a primetime BBC documentary targeted at a broad swathe of audience, not anoraks (such as me) who spend far too long reading this thread. Made certain details far more prominent in the public consciousness, which can only be a good thing.
