The certainly don't lose when they hold a huge purse and the other party is using cheap or free legal advice. The capacity of big businesses to behave as they wish in this way by bullying the little guy is ordinarily depressing. Remember, at the time, Clipboard Kenny was in 'control' (i.e. being told what to do by the Ashley-dominated board). Ashley probably - and very wisely so - saw his regime coming to an end so did as much to put liability onto any new administration as he could, hence the IP transfer and the simply ludicrous loan arrangement here.
