There is no general criminal offence of trespass in Scotland but there are specific offences of criminal trespass and a general delict. They'd photographic evidence of me entering the Range car park at 18.30 on a Thursday and leaving at 13.30 on the Friday and thus exceeding the two hour maximum. I just explained that these were two separate visits. Car was broken into while in a private car park on Tuesday/Wednesday with three windows smashed, a couple of bags taken and our belongings chucked all over the ground. Usual signs up about car park owners have no liability etc so no chance of claiming anything off them. There are signs up (that I've taken photos of) saying the car park is monitored by CCTV - but when my wife emailed them asking about the footage she was told the car park isn't covered by CCTV, despite them claiming otherwise. Given they've lied and I wouldn't have parked there if I'd known there were no cameras, is there anything I can do? I've reported them to trading standards for all the difference that will make, but would be nice if there was a chance of claiming back some of the cost of my new windows. You might have decided for yourself that the provision of CCTV was a service being provided and formed part of your contract but I don't see any way of you being able to evidence that the operator also believed that this was an integral part of the contract. Even if there was they wouldn't have a duty of care to keep your car and belongings safe. If the operator put signs up saying the place was monitored by CCTV and it wasn't, surely that's dishonest trading or anyway something they could be sued for? Even if there was CCTV it wouldn't leave the car park operator liable for a third party committing theft on their premises any more than I could sue Tesco if someone punches me at the deli counter. The best case scenario would be the absence of CCTV voids the contract and Stu can ask for his money back for the parking. As I said you would need to demonstrate that the operator also thought that the provision of CCTV was part of the contract. If they had a sign on the door saying come and use our CCTV protected car park then there might be a case but, as I say, only to claim back for the parking.
