Isn't the BBC deal only for around £3k and being bumped to a Monday night? Even if the they wanted a certain tie I could see the clubs turning it down knowing they'd make more from the gate and hospitality on a Saturday. Clubs have turned it down in the past.

I think there's some crosswires here. When the vote on relegation proposals took place in Spring 2022, CSS or others raised the idea it shouldn't be brought up again until the SPFL brought in changes. Just as the relegation proposal never passed, the anti-relegation idea never passed a full vote. If it had, it would have been enshrined in their constitution.
